KEEP IN MIND
· When commissioning me, please be clear in your messages. You don’t need to be formal, but please be nice!
· Please send commission enquiries and communication via email only. I prefer to keep my twitter DMs for personal use – however if you have a quick question, I am happy to answer it via DMs.
· Please provide both visual references and a short description. References can be images of poses, characters, faces, etc, anything that helps get your point across. If you can only provide a written description there will be a small extra fee for me to go through the design process.
· Please be clear about what you want from your commission. It helps me to be given a clear direction!
· I will draw OCs and fanart.
· I am most comfortable drawing women, however I am open to drawing men or animals as well.
· Please keep my drawing style in mind when thinking of commission ideas! If you’re unsure, feel free to ask.
· I will not draw fully NSFW, however suggestive imagery or tasteful nudity is fine.
· I will not draw furries, gore, mecha, realism or hateful content.
· I will not accept a commission if it is more complex that I feel I can deliver (eg. complex armor, complex outfit designs, large number of characters), however I am definitely willing to discuss other options with you!
· Please keep in mind that I do not work 24/7, so if you see me being active on my social media accounts, it does not mean I have forgotten about your commission. I am a human being and need to take breaks and time to myself, so that I can put 100% into your commissioned work.
· Please do not rush me to finish your commission above others in the queue.
1. GENERAL TERMS
· All drawings will include a signature that you may not remove.
· I may record the drawing process and post it on my YouTube channel.
· Prices are subject to change as I see fit.
· I have the right to reject any commission request that I do not feel comfortable drawing for any reason.
2. PAYMENT
· All prices are set in AUD and payment will be taken through PayPal.
· Commissions will be paid 50% upfront when I accept your commission and 50% after sketch approval.
· I will not begin your commission before receiving any payment and will not release the final piece until I have received the final payment.
· Don't send me any payment before I have agreed to complete your commission and requested you to send me the payment.
3. PROCESS AND DELIVERY
· I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see point 7 further below for more info on refunds)
· While I'm working on your commission, I will give you periodic updates to make sure you are happy with how it is looking.
· If the buyer fails to respond to communication within 1 month, I will put the order on hold and move it to the back of the queue.
· The number of revisions depends on the complexity of the work.
· During the revisions, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.
· The time it takes to finish your commission varies from 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece and other work.
· If anything comes up that will slow the progress of the initially estimated delivery time, I will let you know ASAP.
· Once the piece is finished you will receive the full-resolution image along with a web-friendly size. A physical artwork is not included however can be arranged for an additional price depending on the size of the print and shipping costs. You are also welcome to have it printed yourself.
4. REVISIONS
· A fee will be added if you want something changed on the final drawing - unless, of course, it was a mistake based on my misunderstanding.
· If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
· If your commission requires a large number of revisions due to unclear reference, there may be an additional cost based on an hourly rate.
5. COPYRIGHT / USAGE POLICY
· I, Holly Finlay (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
Promote myself with it anywhere I like
Publish books with it (artbooks, etc.)
Display it anywhere to my liking (website, social media, etc.)
Post it wherever I like
*Please let me know when commissioning if it is a gift/surprise for someone so that I can hold off posting it until you are ready.
The buyer is allowed to:
Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
Print the artwork and claim the character(s) as their own, but not the artwork itself.
Use the artwork to promote themselves. Credit is much appreciated.
Use the artwork on their YouTube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially, including for NFTs- this means making money off it in any way.
Claiming the artwork as your own
Removing my signature from the artwork
Altering the artwork without my consent
*I reserve the full rights to the image and its use/distribution unless otherwise agreed upon.
6. CUSTOMER SATISFACTION
· I will do everything I can to make my customers happy!
· If you have a problem with anything in regard to the commissioned piece, please tell me right away so we can find a solution together.
· I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.
7. REFUND / CANCELLATION POLICY
· The buyer is not allowed a refund once I have started working on the commission.
· If for any reason I am unable to start your commission, you will receive a full refund.
· If you cancel your order before I have started it, you will receive a full refund.
· If you cancel your order after I have completed sketches, you will not get a refund for the first 50%. However, I will not ask for the final 50%.
· I cannot refund your commission price based on you deciding that you cannot afford it. Please be sure that you have the money available to spend before you decide to commission me.
· If for any reason you can no longer pay the second half of your commission price, I will hold off on continuing the piece until I have received payment. We can also discuss other options if you will be unable to complete the payment, for example downgrading the type of commission.
· If I have authorised a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
· If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
If the buyer breaks any of the terms stated above they will lose all the beforementioned rights to the artwork commissioned by me, Holly Finlay (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit.
What do you get?
· Drafts/mockups that you must decide which one I should continue with (depending on the complexity of the commission there might be fewer or more drafts)
· Sketch and/or final sketches that you must accept before I continue the work
· Insight and involvement in colour palette (depending on the complexity of the commissioned piece)
· Full-resolution file at 300 DPI of final drawing and a smaller version for internet upload. Final file formats are usually PNG.
